Most traffic infractions in Virginia (as well as traffic misdemeanors) are punished with DMV demerit points (in addition to fines). The offender will be assessed 3, 4 or 6 points, depending on the severity of the charge. These demerit points will remain on the offender’s Virginia driving record for 2 years, but the conviction for the offense resulting in the points will stay on the driver’s record longer.

If a Virginia driver has accumulated 18 demerit points in a 12 month period, or 24 demerit points in a 24 month period, the DMV will suspend his privilege to drive in Virginia for 90 days. The driver must complete a DMV-approved driver improvement class before he can have his driving privileges reinstated. Once the person’s driving privileges have been restored, the driver will be placed on a 6 month probationary period with the DMV.

If a driver under the age if 18 is convicted of any 2 offenses resulting in DMV demerit points, the DMV will suspend the driver’s license for 90 days.

If the offender drives while his license is suspended, he could be charged with driving on a suspended license, which is a CRIME in Virginia. A third offense driving on suspended license charge in 10 years is punished with a mandatory MINIMUM of 10 days in jail.
