Speeding in Virginia is punished with a fine and DMV demerit points.  The fine can be pre-paid and is usually $6 for every mile per hour over the speed limit the offender was driving and the maximum fine is $250.

However, their is an increased fine for speeding in a work zone in Virginia under Va. Code §46.2-878.1.  This fine also can be pre-paid but it is $7 for every mile per hour over the speed limit the offender was driving and the maximum possible fine increases to $500.

This increased fine for speeding in a work zone in Virginia applies if a driver is speeding in a highway work zone when workers are present and the work zone is marked with signs informing drivers of the speed limit and the penalties for speeding.  A highway work zone in Virginia is a construction or maintenance area on or beside a highway that is marked with appropriate warning signs and flashing lights or traffic control devices indicating that work is in progress.

Since the fine for speeding in a work zone in Virginia can be pre-paid, the driver does not need to appear in court if he pays the ticket.  However, paying the fine for speeding in a work zone in Virginia is an admission of guilt to the charge and will result in a conviction for speeding on the offender’s Virginia driving record and this conviction will remain on his record for 5 years.
