Speeding in Virginia is usually a traffic infraction. When a driver is charged with speeding, he receives a ticket. Speeding, like other traffic infractions, is punished with a fine up to $250 and carries automatic DMV demerit points. The number of points depends on how many miles over the speed limit the offender was driving.
If a driver receives a speeding ticket, he is charged with committing a traffic infraction. However, driving more than 20 miles over the speed limit, or driving more than 80 miles per hour, regardless of the posted speed limit, is considered Reckless Driving, which is a crime in Virginia.
Reckless Driving in Virginia (Va. Code §46.2-862) is a Class 1 misdemeanor. It is punished with up to 12 months in jail, a fine up to $2,500, and up to 6 months of driver’s license suspension. A Reckless Driving conviction will also automatically result in 6 DMV demerit points. Perhaps most importantly, a conviction will remain on a driver’s permanent criminal record and can never be expunged.
