Is Speeding A Crime in Virginia?
Unfortunately, sometimes it is. Driving more than 20 miles per hour over the speed limit or more than 80 miles per hour is considered Reckless Driving in Virginia (Va. Code §46.2-862). Reckless Driving is a Class 1 misdemeanor. It is punished with up to 12 months in jail, a fine up to $2,500, and up to 6 months of driver’s license suspension. A Reckless Driving conviction will also automatically result in 6 DMV demerit points. Accumulating too many points in a short time period can lead to DMV driver’s license suspension.
