License Revocation No Longer Punishment for Drug Convictions in Virginia

Many changes to criminal laws in Virginia took effect in 2020. Specifically, Virginia enacted significant changes to drug laws, including marijuana decriminalization (and eventual legalization) and removing the requirement of driver’s license revocation for drug convictions. License Revocation No Longer Punishment for Drug Convictions in Virginia
In July 2020, Virginia removed the requirement of driver’s license revocation after a drug conviction. Previously, anyone convicted of almost any drug offense would also have his or her driver’s license automatically revoked for 6 months as a result of a conviction. This even applied to deferred adjudications of guilt available to first time offenders that resulted in charges being dismissed.
While this change is a big step in helping many people keep their driver’s licenses, there still are a number of other reasons that a person’s driver’s license can be revoked in Virginia, including (but not limited to) convictions for various offenses committed while operating a motor vehicle (such as DUI convictions, felony convictions involving the use of a motor vehicle, and a third conviction resulting in demerit points committed by a person when he or she was under 18), taking a driver’s test for another person, or providing false information to obtain a driver’s license.
