Many changes to Virginia criminal laws took effect in 2020, including significant changes to drug laws. Virginia is No Longer Revoking Driver’s License After Drug Convictions

In July 2020, Virginia removed the requirement of driver’s license revocation for drug convictions. Previously, anyone convicted of nearly any drug charge would also have his or her driver’s license automatically revoked for 6 months after a conviction. This even applied to deferred adjudications of guilt available to first time offenders that resulted in drug charges being dismissed.

This change is a significant step in helping many people keep their driver’s licenses in Virginia. However, there are still a number of other reasons that a person’s driver’s license can be revoked in Virginia, including convictions for various motor vehicle offenses (such as DUI convictions, felony convictions involving the use of a motor vehicle, and a third conviction resulting in DMV demerit points committed by a person when he or she was under the age of 18), taking a driver’s test for another person, or providing false information on a driver’s license application.
