Penalty for Virginia Driving on a Suspended License Charge

Driving on a Suspended License in Virginia Va. Code (§46.2-301) is a Class 1 misdemeanor and is punished with up to 12 months in jail, a fine up to $2,500, and mandatory additional driver’s license suspension. The Virginia DMV will automatically add 6 demerit points to a person’s  driving record if he or she is convicted of a Driving on Suspended License charge in Virginia.

A third offense Virginia Driving on a Suspended License Charge used to be punished with a mandatory minimum 10 day jail sentence. Good time credit did not apply and a person had to serve the entire 10 days. However, the law recently changed and this mandatory minimum jail sentence no longer applies to an offender convicted of a third offense Driving on Suspended License charge in Virginia.
