Shooting From Vehicle
Virginia criminalizes a number of different acts involving shooting, carrying, possessing, and handling firearms. There are many statutes that criminalize shooting at or in certain places. One of these crimes is Shooting from a Vehicle in Virginia (Va. Code §18.2-286.1).
Shooting from a Vehicle in Virginia
Any person who, while in or on a motor vehicle, intentionally discharges a firearm so as to create the risk of injury or death to another person or thereby cause another person to have a reasonable apprehension of injury or death, has committed a felony under Va. Code §18.2-286.1.
To convict an offender of this offense, the Commonwealth must prove that the person:
- intentionally
- discharged
- a firearm
- while in a motor vehicle
- so as to create the risk of injury or death to another person, or
- by shooting caused another person to have a reasonable apprehension of injury or death
There is an obvious exception for a law-enforcement officer in the performance of his duties.
Penalty for Shooting from a Vehicle in Virginia
Shooting from a Vehicle under Va. Code §18.2-286.1 is a Class 5 felony. It is punished with up to 10 years in prison and a fine up to $2,500.
