What is a Hit and Run in Virginia?
A Virginia Hit and Run can be charged if a driver or even a passenger in a vehicle involved in an accident fails to report that accident. Virginia law requires that a driver involved in an accident stop and provide the other driver (or police) with his name, address, driver’s license number, and vehicle registration number. If the accident involved uattended property and the driver cannot locate the property owner, he must leave a note with this information as well as his contact information, the date, time and location of the accident, and a description of the property damage. He also is required to notify the police within 24 hours.
A passenger over the age of 16 can also be criminally charged for failing to report an accident if he knew the driver did not report the accident to the police and fails to make a report himself within 24 hours.
Hit and Run Penalties in Virginia
A Hit and Run in Virginia is punished with jail (or prison), fines, driver’s license suspension or revocation, and DMV points.
A Virginia Hit and Run involving property damage is usually a misdemeanor. However, if the accident resulted in more than $1,000 in damage to attended property, it is a felony. If someone was injured or killed as a result of the accident, the offense is also a felony.
