Penalties for Virginia Racing Charge
Racing in Virginia is usually a Class 1 misdemeanor. It is punished with up to 12 months n jail, a fine up to $2,500, driver’s license suspension for 30 days up to 12 months, and 6 DMV demerit points. Additionally, if the vehicle’s owner was convicted of racing in a prearranged, organized, and planned speed competition, is present in the vehicle during the race, and consents to the race, his vehicle will be seized and forfeited.
However, a Virginia Racing charge can sometimes be a felony. If a person involved in a race engaged in behavior that was so gross, wanton and culpable as to show a reckless disregard for human life, and caused serious bodily injury to another person not involved in the race, he will be charged with a Class 6 felony. This offense can be punished with up to 5 years in prison, a fine up to $2,500, driver’s license revocation for 1-3 years, and 6 DMV demerit points. If the person convicted of this felony racing charge owned the vehicle, his vehicle will be seized and forfeited.
