Driving on Revoked License in Virginia Penalties: Second Offense

Code §18.2-272 makes it a Class 1 misdemeanor for anyone to drive after his license has been revoked because of a Virginia DUI or Breathalyzer Refusal conviction.  It is also a Class 1 misdemeanor to operate a vehicle with a Blood Alcohol Content (BAC) higher than .02 while revoked because of a DUI-related conviction.  Additionally, Driving on a Revoked License can be charged if the driver violates the terms of a restricted license that was issued after a Virginia DUI conviction.

A first or second offense Virginia Driving on Revoked License charge under Va. Code §18.2-272 is a misdemeanor.  A third offense within 10 years is a felony.

Second Offense Virginia Driving on Revoked License Penalties

A second offense driving on revoked license charge in Virginia is a Class 1 misdemeanor.  It is punished with jail, fines, and further driver’s license revocation, among other penalties.

  • Jail: A second offense Virginia driving on revoked license charge is punished with up to 12 months in jail.
  • Fines:  The driver faces a fine up to $2500 if convicted of a second offense Virginia driving on revoked license charge.
  • Driver’s License Revocation: A driver’s license will be administratively revoked for 3 years after being convicted of a second offense Virginia driving on revoked license charge.
  • No Restricted License: Anyone whose license has been revoked as a result of a driving on  revoked license conviction is not allowed to have a restricted license at all during the additional period of license revocation.
  • Vehicle Impoundment: The offender’s vehicle will be impounded as soon as he is arrested for a second offense driving on revoked license offense in Virginia.
  • DMV Points: The Virginia DMV will add 6 demerit points to a driver’s record upon being convicted of a second offense Virginia driving on revoked license charge.
  • Criminal Conviction: Driving on a Revoked License is a crime in Virginia and any conviction will remain on the driver’s permanent criminal record.
