Can I Be Sued for a Speeding Conviction in Virginia?

Speeding tickets are pre-payable offenses, meaning they can be paid before the court date and the driver doesn’t even need to go to court at all.

However, pre-paying a ticket is an admission of guilt, which results in a conviction for speeding on the person’s driving record, the driver will have the associated DMV demerit points on his or her record, and the driver will have to pay court costs in addition to the fine. Va. Code §16.1-69.48:1.

If you do go to court and plead no contest, guilty, or are found guilty, you will have the same penalties imposed as if you pre-paid the Speeding ticket, and that will be more than a fine. You will have to pay court costs, the conviction will be on your Virginia driving record, and the DMV will add the associated demerit points to your record.

If the speeding involved or resulted in an accident, and you admit guilt (by pre-paying the ticket or pleading guilty or even no contest in court), this could be used against you in a future civil lawsuit. This can impact your liability and the judgment that may be imposed against you.
