Driving a Vehicle Not Under Proper Control in Virginia under Va. Code §46.2-853 is a crime. It is a Class 1 misdemeanor, punished with up to 12 months in jail, a fine up to $2,500, up to 6 months of driver’s license suspension, and the conviction will remain on the offender’s Virginia driving record for 11 years. Most importantly, it will remain on the offender’s criminal record permanently.

Additionally, if the offender was in violation of the Handheld Communication Device Law, there will be a mandatory minimum fine of $250.

The offender can apply for a restricted license allowing him to drive to specified places at certain times in the discretion of the court.

If the court thinks that alcohol or drugs were involved in the incident, the court can require the person to enroll in and complete the Virginia Alcohol Safety Action Program (ASAP). Additionally. the offender can choose to have an Ignition Interlock installed in his vehicle for at least 6 months without any alcohol-related violations as the only restriction of the restricted license if an Ignition Interlock is required.
