Driving Vehicle with Faulty Brakes in Virginia

Reckless Driving in Virginia is much more than a simple traffic ticket-it is a crime, and sometimes can even be charged as a felony. To convict an offender of Driving a Vehicle Which is Not Under Control or Driving a Vehicle with Faulty Brakes in Virginia under (Va. Code §46.2-853), the Commonwealth must prove that the offender:

  • drove
  • a vehicle
  • which is not under proper control or which has inadequate or improperly adjusted brakes
  • on any highway in the Commonwealth
Penalty for Driving Vehicle Not Under Control or with Faulty Brakes in Virginia

Driving a Vehicle Not Under Control or with Faulty Brakes in Virginia under Va. Code §46.2-853 is a crime. It is a Class 1 misdemeanor, punished with up to 12 months in jail, a fine up to $2,500, up to 6 months of driver’s license suspension, the DMV will automatically assess 6 demerit points to the person’s DMV record, and the conviction will remain on the offender’s Virginia driving record for 11 years. Most importantly, it will remain on the offender’s permanent criminal record.

The offender can apply for and obtain a restricted license allowing him to drive to specified places at certain times in the discretion of the court. Additionally, if the offender was in violation of the Handheld Communication Device Law, there will be a mandatory minimum fine of $250.

If the court thinks that alcohol or drugs are involved in the incident, the court can require the person to enroll in and complete the Virginia Alcohol Safety Action Program (ASAP). Additionally. the offender can choose to have an Ignition Interlock installed in his vehicle for at least 6 months without any alcohol-related violations as the only restriction of the restricted license.
