To convict an offender of Driving a Vehicle with Improperly Adjusted Brakes in Virginia under Va. Code §46.2-853, the Commonwealth must prove that the offender:

- a vehicle
- which had improperly adjusted brakes
- on any highway in the Commonwealth
Penalty for Driving a Vehicle with Improperly Adjusted Brakes in Virginia
Driving a Vehicle with Improperly Adjusted Brakes in Virginia under Va. Code §46.2-853 is a crime. It is a Class 1 misdemeanor, punished with up to 12 months in jail, a fine up to $2,500, up to 6 months of driver’s license suspension, the DMV will automatically assess 6 demerit points to the person’s DMV record, and the conviction will remain on the offender’s Virginia driving record for 11 years. Most importantly, it will remain on the offender’s permanent criminal record.
Additionally, if the offender was in violation of the Handheld Communication Device Law, there will be a mandatory minimum fine of $250.
If the court thinks that alcohol or drugs are involved in the incident, the court can require the person to enroll in and complete the Virginia Alcohol Safety Action Program (ASAP) as well as require the offender to install an Ignition Interlock in his vehicle.
