Overtaking and Passing a Vehicle on the Crest of Grade or Curve in Virginia is a Crime

To convict an offender of Overtaking and Passing Vehicle on Crest of Grade or Curve in Virginia under Va. Code §46.2-854, the Commonwealth must prove that the offender:

  • while driving
  • a vehicle
  • overtakes and passes
  • another vehicle
  • proceeding in the same direction
  • on or approaching the crest of a grade or
  • on or approaching a curve in the highway
  • where the driver’s view along the highway is obstructed

There is an exception to this charge where the overtaking vehicle is being operated on a highway having two or more designated lanes of roadway for each direction of travel or on a designated one-way roadway or highway.

It is a Class 1 misdemeanor and is punished with up to 12 months in jail, a fine up to $2,500, and driver’s license suspension up to 6 months. The DMV will also add 6 demerit points to the offender’s Virginia driving record. Because it is a crime, a conviction will remain on the offender’s permanent criminal record.
